Terms and conditions:

1. Scope
These terms and conditions apply to all deliveries made by AKivent GmbH (hereinafter referred to as “AKivent”) to consumers outside of the following platforms: Ebay, Amazon, Etsy, Kaufland. A consumer is any natural person who concludes a legal transaction for a purpose that can mainly not be attributed to their commercial or self-employed professional activity.

3. Conclusion of the contract
The representation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order.
By clicking the [Buy/order at a cost] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order with an order confirmation by email immediately after receiving your order

4. Right of withdrawal
If you are a consumer (i.e. a natural person who places an order for a purpose that cannot be attributed to their commercial or self-employed professional activity), you have a right of revocation in accordance with the statutory provisions.
If you as a consumer exercise your right of revocation in accordance with section 4.1, you will have to bear the regular costs of return.
Furthermore, the regulations for the right of revocation are those that are individually set out in the following Instructions on withdrawal¹

5. Instructions on withdrawal
You have the right to revoke this contract within fourteen days without giving any reason.The revocation period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the goods or has.To exercise your right of revocation, you must inform us [AKivent GmbH, Thalenhorststraße 18, 0421 9899 9550 and info@akivent.de] by means of a clear statement (e.g. a letter sent by post or an email) of your decision to revoke this contract.
You can use the sample revocation form for this, but it is not mandatory. You can also send us another clear statement through the contact details or contact form mentioned above. If you take advantage of this option, we will immediately (e.g. by email) send you a confirmation of receipt of such revocation.

To comply with the revocation period, it is sufficient for you to send the notification of the exercise of the right of revocation before the revocation period expires. Consequences of revocation. If you revoke this contract, we will reimburse you for all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a different delivery method than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which the notification of your revocation of this contract has been received by us. We will use the same payment method that you used for the original transaction, unless otherwise explicitly agreed with you; in no case will you be charged any fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof of shipment of the goods, whichever is the earlier.

You must return or hand over the goods to us or to (here, if applicable, enter the name and address of the person authorized by you to receive the goods) without delay and in any case no later than fourteen days from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the end of the fourteen-day period.

You will bear the direct costs of returning the goods, unless we indicate otherwise.

You will only be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their nature, characteristics and functionality

6. Prices and shipping costs
The prices listed on the product pages include the statutory value-added tax and other price components. If not otherwise specified, we will additionally charge a flat rate of 5.99 euros for delivery within Germany per order. The final shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system, and/or on the order page. If paying by cash on delivery, an additional fee of 4.40 euros will be charged, which will be collected by the delivery person on site. No further taxes or costs will apply.

7. Delivery
Delivery is made with DHL, Hermes, DPD, GLS or UPS. The delivery time is usually up to 3 days with in Germany. We indicate any deviating delivery times on the respective product page. Unfortunately, due to global circumstances, there are often delays in the delivery process which we have no control over.

8. Payment
Payment can be made either by advance payment, credit card, paypal or cash on delivery. The sales platforms often offer their own payment methods that you can use (e.g. Ebay managed Payments, Amazon Payments, etc.)

When selecting the payment method advance payment, we will provide our bank details in the order confirmation and deliver the goods after receipt of payment.

9. Retention of the title
The goods remain our property until full payment is made

10. Dispute resolution
The European Commission has created an online platform for the resolution of disputes. The platform serves as a point of contact for the out-of-court resolution of disputes concerning contractual obligations arising from online purchase contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are willing and/or required (depending on the specific legal requirements or contractual agreement) to participate in a dispute resolution process with consumers before a consumer arbitration board. The competent consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.
To resolve the disputes mentioned, we will participate in a dispute resolution process before this body.
